Bienvenido/a a SignaSuite, tu plataforma de firma electrónica. La presente Política de Privacidad tiene como objetivo informarte sobre cómo PEAKWAY SL. (en adelante, "nosotros", "nuestro" o "el Responsable del Tratamiento") recopila, utiliza, protege y comparte tus datos personales cuando utilizas nuestros servicios.

We are committed to protecting your privacy and complying with applicable data protection legislation, in particular, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), and Organic Law 3/2018, of December 5, on Personal Data Protection and guarantee of digital rights (LOPDGDD).

The documents you upload to the platform for electronic signature. These documents may contain personal data of signers or third parties.

Signer data (when you act as a user requesting signatures)

Name, email and other data you include about signers to manage the signing process.

Any other information you voluntarily provide us through contact forms, surveys, etc.

Article 11. Transparency and information to the data subject
In accordance with Article 11 of the LOPDGDD, when personal data has not been obtained directly from the data subject (for example, signer data provided by the user initiating the signing process), we will inform said data subject in the first communication or within a maximum period of one month, except for legal exceptions.

4. Purposes of Processing your Data

We process your personal data for the following purposes:

Provision of electronic signature service

  • Manage your user account.
  • Allow uploading, sending, signing and storing electronic documents.
  • Verify the identity of signers (according to the level of electronic signature offered).
  • Generate electronic evidence of the signing process.
  • Facilitate communication between parties involved in a signing process.

Contractual and administrative management

  • Manage the contractual relationship with you.
  • Billing and collection of services (if applicable).
  • Attend to your queries, requests or complaints.

Compliance with legal obligations

  • Comply with legal obligations applicable to us, for example, in tax, commercial or money laundering prevention matters (if applicable).

Article 8. Processing of data by legal obligation, public interest or exercise of public powers of the LOPDGDD establishes that processing by legal obligation must be provided for in a rule with the rank of law.

Improvement of our services

  • Analyze platform usage to improve its functionality, usability and security.
  • Conduct satisfaction surveys.

Security

  • Ensure platform security and prevent fraud or illegal activities.

Commercial communications

(if we have your consent or there is a prior contractual relationship and similar products are offered, in accordance with the LSSI)

  • Send you information about news, promotions or products related to our electronic signature services. You can object at any time.

6. How long will we keep your data?

We will keep your personal data for the time strictly necessary to fulfill the purposes for which they were collected, and while you maintain your contractual relationship with us.

Once the contractual relationship has ended or deletion has been requested (and provided there are no legal obligations requiring their retention), your data will be blocked during the legal periods established for addressing possible liabilities arising from the processing. After these periods, we will proceed to their definitive deletion.

Electronically signed documents
Electronically signed documents and associated electronic evidence will be kept according to the periods you determine as the user responsible for said documents, or according to the legal periods applicable to the nature of said documents. We, as service providers, will keep them as long as you indicate or for the duration of the contracted service, without prejudice to retention obligations that may arise from specific trust services regulations.

7. Who do we share your data with?

We will not transfer your personal data to third parties, unless there is a legal obligation or it is strictly necessary for the provision of the service. In particular:

When you initiate a signing process, the necessary identification data and documents will be shared with the other signers or parties you have designated.

Service providers

Podemos contratar a terceros (encargados del tratamiento) para que nos presten determinados servicios (ej. alojamiento web, servicios de pago, soporte técnico). Estos terceros solo tendrán acceso a los datos personales necesarios para realizar sus funciones y estarán obligados contractualmente a mantener la confidencialidad y a cumplir con la normativa de protección de datos.

We may communicate your data to judicial, administrative authorities, security forces and bodies, when required by law.

8. Your Data Protection Rights

As data subject, you have the right to exercise the following rights, recognized in articles 15 to 22 of the GDPR and developed in Article 12. General provisions on exercise of rights of the LOPDGDD:

Right of access

To know if we are processing your data and, if so, access them.

Right to rectification

To request correction of inaccurate or incomplete data.

Right to erasure

("right to be forgotten"): To request deletion of your data when, among other reasons, they are no longer necessary for the purposes for which they were collected.

Right to restriction of processing

To request restriction of processing of your data in certain circumstances.

Right to data portability

To receive your personal data in a structured, commonly used and machine-readable format, and to transmit them to another controller, in certain circumstances.

Right to object

To object to the processing of your data for reasons related to your particular situation, in certain circumstances (e.g. processing based on legitimate interest, direct marketing, profiling).

Right not to be subject to automated individual decision-making

Including profiling, which produces legal effects on you or significantly affects you in a similar way.

Complaint to the AEPD
If you consider that your rights have not been properly addressed, you have the right to file a complaint with the Spanish Data Protection Agency (AEPD) (www.aepd.es). The AEPD is the independent administrative authority at state level mentioned in Article 44. General provisions of the LOPDGDD.

We have adopted appropriate technical and organizational measures to ensure a level of security appropriate to the risk, in accordance with Article 28. General obligations of the controller and processor of the LOPDGDD and article 32 of the GDPR. These measures seek to protect your personal data against accidental or unlawful destruction, loss or alteration, or unauthorized communication or access.

According to Article 4 of the LOPDGDD, we will not be responsible for data inaccuracy if we have adopted reasonable measures and the inaccurate data was obtained directly from the data subject or from the other sources mentioned in said article.

11. Minors

Our services are not directed to minors under 14 years of age, unless they have the consent of their parents or legal guardians.

If you are aware that a minor under 14 years of age has provided us with personal data without such consent, please let us know so we can proceed to delete it.

12. Privacy Policy Modifications

We may modify this Privacy Policy at any time. Any changes will be published on this page and, if the changes are significant, we will notify you by email or through a prominent notice on our platform before the change takes effect.
